Article 33 stipulates that anyone who

The penalty for the crimes stipulated in this article is death and a fine of not less than one hundred thousand pounds and not exceeding five hundred thousand pounds in the following cases:
1 – If the perpetrator employs in committing one of these crimes someone who has not reached the age of twenty-one years, or employs one of his ascendants or descendants, or his spouse, or one of those whom he is responsible for raising or supervising, or who has actual authority over them in supervising or directing them.
2 – If the offender is one of the employees or employees charged with implementing the provisions of this law or who is entrusted with combating drugs or controlling their circulation or possession, or if he has any connection with them in any way.
3 – If the perpetrator exploits in committing or facilitating the authority granted to him by virtue of his position, his work, or the immunity granted to him in accordance with the Constitution or the law.
4 – If the crime occurred in one of the houses of worship, educational institutions and their service facilities, clubs, public parks, treatment places, social or penal institutions, camps or prisons, or in the immediate vicinity of these places.
5 – If the perpetrator provides the narcotic substance, delivers it, or sells it to someone who has not reached the age of twenty-one years, or forces him to take it by any means of coercion, deception, inducement, temptation, or facilitation.
6 – If the narcotic substance involved in the crime is cocaine, heroin, or any of the substances listed in the first section of Schedule No. (1) attached.
7 – If the perpetrator has previously been convicted of one of the felonies stipulated in this article or the previous article.
Article 35 – The following shall be punished by life imprisonment with hard labor and a fine of not less than fifty thousand pounds and not exceeding two hundred thousand pounds:
1- Anyone who manages or prepares a place for others to consume narcotic substances without compensation.
2- Anyone who facilitates or provides for the use, without compensation, of a narcotic substance in circumstances other than those authorized by law.
